Privacy Policy

1. PURPOSE

Your privacy is important to Scaled Inference, Inc. (“Scaled Inference”, “we”, or “us”). This Privacy Policy is incorporated by reference into the Scaled Inference Terms and Conditions (the “Terms”). This Privacy Policy spells out our commitment to protect that trust.  The terms “Scaled Inference,” “we,” and “us” include Scaled Inference and our affiliates and subsidiaries. It explains Scaled Inference’s privacy practices for ScaledInference.com, Amp.ai and their subdomains (each a “Site”, and collectively the “Sites”); our client library communications platform (“Customer Platform”) and other products and sites we may later own or operate. This Privacy Policy explains our online and offline information practices, the kinds of information we may collect, how we collect that information, how we intend to use it, how we protect it, and how you can opt out of a use or correct or change such information. By visiting the Sites, you accept this Privacy Policy’s terms.

2.  SCOPE

This Privacy Policy applies to Personal Information that is Processed by Scaled Inference in the course of our business, including on our Sites, mobile applications, forums, blogs and other online or offline offerings (together with any and all future online and offline offerings operated by or on behalf of Scaled Inference, “the “Services”).  All individuals whose responsibilities include the Processing of Personal Information on behalf of Scaled Inference are expected to protect data in adherence to this Privacy Policy. We are not responsible for the practices employed by any Third-Party sites including ones to which we link or that link to us. Those sites will have rules and practices of their own.

3.  TRANSPARENCY/NOTICE – TYPES OF PERSONAL INFORMATION WE COLLECT OR RECEIVE AND HOW WE USE IT

We collect information from you on our Sites to provide a personalized and optimized experience for end users. We use this information to:

  • Make it easier for you to use these Sites,
  • Communicate with you about the Sites,
  • Verify your identity when you log in to our Sites,
  • Help you more quickly find information on Scaled Inference’s products and Services,
  • Provide targeted online marketing for the Sites,
  • Create content on these Sites that is of greater value to you and your end users, and
  • Alert you to new products and Services that might specifically interest you.

The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with Scaled Inference and the requirements of applicable law.  Some of the ways that we may collect Personal Information include:

  • You may provide Personal Information directly to us through interacting with the Services, participating in surveys, during events such as sweepstakes, and requesting Services, or information.
  • As you navigate the Services, certain passive information may also be collected about your visit, including through cookies and similar technologies as described below.

We endeavor to collect only that information which is relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.

3.1 TYPES OF PERSONAL INFORMATION WE COLLECT

Scaled Inference collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, and guests (collectively “Individuals”).

Information we collect from you may be either individual or aggregate. Individual information is identifiable to you, like your name, email address, shipping and billing addresses, credit card information, and phone number. Aggregate information is summary data of the behaviors and interests of groups or categories, so it won’t identify you.

Information You Provide Directly to Us. When you use the Services or engage in certain activities, such as registering for an account with Scaled Inference, responding to surveys, requesting Services or information, or contacting us directly, we may ask you to provide some or all of the following types of information.  By providing information to Scaled Inference, you represent that you have authority to do so. If you provide us your email address on one of our Sites, but do not complete your login, then we may retain your email address for a period to invite you back to the Sites and to share information with you about Scaled Inference’s Amp.ai platform.

  • When You Contact Us. If you want to contact Scaled Inference using the Sites, then you can choose to complete our contact form. We use this information consistent with this Privacy Policy to honor your requests for information about Scaled Inference. We also will retain your information for a period to invite you back to the Sites and to share information with you about Scaled Inference’s Amp.ai platform.
  • Surveys.  From time to time, we may contact you to participate in online surveys. If you do decide to participate, you may be asked to provide certain information which may include Personal Information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our products, Sites and/or Services and in any manner consistent with the policies provided herein.
  • Posting on the Site.  Our Sites offer publicly accessible chat function(s). You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. If you choose to submit content to any public area of the Site, such content will be considered “public” and will not be subject to the privacy protections set forth herein.  
  • Automatic Data Collection.  We may collect certain information automatically through our Services or other methods or web analysis.  Like most sites, Scaled Inference automatically receives and stores in log files certain information from your browser when you visit the Sites. This information includes your Internet protocol (“IP”) address, browser type and language, Internet service provider, the referring/exit pages, your operating system, and the date/time stamp of your Site visit.  We use this information, which doesn’t identify individual Site visitors, to analyze and understand how the Sites works for you so we can improve it, to administer the Sites, and to gather demographic information about Site visitors for targeted online marketing purposes. We may link this automatically collected information to your information. We may also collect your device ID, access times, the content of any undeleted cookies that your browser previously accepted from us, and the referring site address.
  • Cookies and other tracking technologies. Please review our Cookie and Tracking Policy below.
  • Information Submitted Via Services.  You agree that Scaled Inference is free to use the content of any communications submitted by you via the Services, including any ideas, inventions, concepts, techniques, or know-how disclosed therein, for any purpose including developing, manufacturing, and/or marketing goods or Services. Scaled Inference will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) you grant us permission to do so; (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or (c) we are required to do so by law.
  • Information from Other Sources.  We may receive information about you from other sources, including through Third-Party services and organizations to supplement information provided by you. For example, if you access our Services through a Third-Party application, such as an App Store or SNS, we may collect information about you from that Third-Party application that you have made public via your privacy settings. Information we collect through App Stores or SNS accounts may include your name, your SNS user identification number, your SNS user name, location, sex, birth date, email, profile picture, and your contacts on the SNS. This supplemental information allows us to verify information that you have provided to Scaled Inference and to enhance our ability to provide you with information about our business, products, and Services.

3.2 HOW SCALED INFERENCE USES YOUR INFORMATION

We collect information from you on these Sites to provide a personalized and optimized experience for end users. We use this information to:

  • Provide Products, Services, or Information Requested.  Scaled Inference may use information about you to fulfill requests for products, Services, or information, including information about potential or future Services, including to:
    • Generally manage Individual information;
    • Respond to questions, comments and requests;
    • Make it easier for you to use these Sites;
    • Communicate with you about the Sites;
    • Help you more quickly find information on Scaled Inference’s products and Services;
    • Alert you to new products and Services that might specifically interest you.
  • Administrative Purposes. We may also use Personal Information about you for administrative purposes, including to:
    • Measure interest in our Services;
    • Develop new products and Services;
    • Ensure internal quality control;
    • Verify your identity when you log in to our Sites;
    • Communicate about Individual accounts and activities on our Sites,  Services and systems, and, in our discretion, changes to any Scaled Inference policy;
    • Send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance;
    • Process payment for products or Services purchased;
    • Process applications and transactions;
    • Prevent potentially prohibited or illegal activities;
    • Enforce our Terms.
  • Marketing Scaled Inference Products and Services.  We may use Personal Information to provide you with materials about offers, products, and Services that may be of interest, including new content or Services. Scaled Inference may provide you with these materials by phone, postal mail, facsimile, or email, as permitted by applicable law. Such uses include:
    • Provide targeted online marketing for the Sites;
    • Create content on these Sites that is of greater value to you and your end users;
    • To tailor content, advertisements, and offers;
    • To notify you about offers, products, and Services that may be of interest to you;
    • To provide Services to you and our sponsors;
    • Tor other purposes disclosed at the time that Individuals provide Personal Information; or
    • Otherwise with your consent.

You may contact us at any time to opt out of the use of your Personal Information for marketing purposes, as further described below.

  • Research and Development.  Scaled Inference may use Personal Information to create non-identifiable information that we may use alone or in the aggregate with information obtained from other sources, in order to help us to optimally deliver our existing products and Services or develop new products and Services. From time to time, we may perform research (online and offline) via surveys. We may engage Third-Party service providers to conduct such surveys on our behalf. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve Individuals by learning more about their needs and the quality of the products and services we provide. The survey responses may be utilized to determine the effectiveness of our Services, various types of communications, advertising campaigns, and/or promotional activities. If an Individual participates in a survey, the information given will be used along with that of other study participants. We may share anonymous Individual and aggregate data for research and analysis purposes.
  • Direct Mail, Email and Outbound Telemarketing. Individuals who provide us with Personal Information, or whose Personal Information we obtain from Third-Parties, may receive periodic emails, newsletters, mailings, or phone calls from us with information on Scaled Inference’s or our business partners’ products and services or upcoming special offers/events we believe may be of interest. We offer the option to decline these communications at no cost to the Individual by following the instructions below.
  • Services via Mobile Devices. From time to time, Scaled Inference may provide Services that are specifically designed to be compatible and used on mobile devices. Scaled Inference will collect certain information that your mobile device sends when you use such Services, like a device identifier, user settings, location information, mobile carrier, and the operating system of your device. Mobile versions of Scaled Inference’s Services may require that users log in with an account. In such cases, information about use of mobile versions of the Services may be associated with accounts. In addition, Scaled Inference may enable Individuals to download an application, widget, or other tool that can be used on mobile or other computing devices. Some of these tools may store information on mobile or other devices. These tools may transmit Personal Information to Scaled Inference to enable Individuals to access accounts and to enable Scaled Inference to track use of these tools. Some of these tools may enable users to email reports and other information from the tool. Scaled Inference may use personal or non-identifiable information transmitted to Scaled Inference to enhance these tools, to develop new tools, for quality improvement and as otherwise described in this Privacy Policy or in other notices Scaled Inference provides.
  • Aggregate Information. We use aggregate information for the purposes of internal business research, sales and business development. We may share aggregated information about our visitor base with third parties such as our advertising partners. This information may include the number of daily visitors to our Sites. We do not aggregate data with our visitors’ information.
  • Sharing Content with Friends or Colleagues. Scaled Inference’s Services may offer various tools and functionalities. For example, Scaled Inference allows you to provide information about your friends through our referral services, such as “Tell a Friend.” Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Email addresses that you may provide for a friend or colleague will be used to send your friend or colleague the content or link you request, but will not be collected or otherwise used by Scaled Inference or any other Third Parties for any other purpose.
  • Other Uses.  Scaled Inference may use Personal Information for which we have a legitimate interest, such as direct marketing, individual or market research, anti-fraud protection, or any other purpose disclosed to you at the time you provide Personal Information or with your consent.

3.3 USE OF COOKIES PIXEL TAGS/WEB BEACONS ANALYTICS INFORMATION, AND INTERNET-BASED ADVERTISING

We use a variety of technologies to help us understand how you use the Sites and the Services. This section explains the tracking technologies Scaled Inference uses and is part of our commitment to a high standard of transparency in our privacy practices.

Types of Tracking Technologies

  • Cookies. This is a small data file sent from a server to your web browser that is stored in your browser and sent back to the server each time the browser makes a request to the server. Cookies can improve a Site user’s experience by, for example, allowing the Site to keep a user logged in while browsing, saving a user’s Site preferences, and allowing a user to add items to a shopping cart and preserve cart contents between Site visits, even when the user is not logged in.  We may use single session cookies to ensure the Site displays correctly on your device. We may use cookies to measure Site metrics such as which pages are popular, how often people visit the Sites, whether people are visiting the Sites for the first time, and whether visitors make purchases on the Sites. They also are used to enhance Site functionality. We may also use cookies to measure the effectiveness of our email communications and to tailor email content. For example, we may connect the data showing that you clicked a link in an email from Scaled Inference then completed an action on our Sites such as logging in to your customer control panel.
  • Clear gifs, web beacons, tracking pixels. These are tiny graphics with a unique identifier. They function similarly to cookies and are used to track the online movements of web users. Unlike cookies which are stored on a user’s computer hard drive, clear gifs are embedded on web pages and are a single pixel wide. Scaled Inference does not tie information gathered by clear gifs to your information.
  • Social Media Widgets. Our Sites may include social media features, such as the Facebook button and/or widget. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a Third-Party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing it.
  • Analytics. We may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on some of our Services, and to develop website content.     • Single-session tracking technology: lasts only as long as your Site visit. Single-session cookies expire and delete themselves when you leave the Site or close your browser. They are used for technical purposes such as enabling better navigation through a Site or generating aggregated statistics about how a Site is used. Single-session cookies do not publicly expose your information.
    • Multi-session or persistent tracking technology: remains on your browser or mobile device until you choose to delete it or the cookie expires. Persistent cookies are used to recognize a computer that has previously visited a Site. This can improve the user’s experience, for example by continuing preference settings from previous visits and by allowing users to login without entering a password with every Site visit.Tracking PurposesWe use tracking technologies for these general purposes:
    • Because it is operationally necessary. This tracking is needed to make the Sites work properly.  We may use cookies, web beacons, or other similar technologies that are necessary to the operation of our Sites, Services, applications, and tools. This includes technologies that allow you access to our Sites, Services, applications, and tools; that are required to identify irregular Site behavior, prevent fraudulent activity and improve security; or that allow you to make use of our functions such as shopping-carts, saved search, or similar functions.
    • For performance. This tracking helps Scaled Inference understand how the Sites are functioning so Scaled Inference can improve the Sites. We may use cookies, web beacons, or other similar technologies to assess the performance of our Sites, applications, Services, and tools, including as part of our analytic practices to help us understand how our visitors use our Sites, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our Site content, applications, Services, or tools.
    • For functionality. This tracking retains your personal preferences as you use the Sites.  We may use cookies, web beacons, or other similar technologies that allow us to offer you enhanced functionality when accessing or using our Sites, Services, applications, or tools. This may include identifying you when you sign into our Sites or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our Sites.
    • For advertising. This tracking gathers data to help deliver content, including advertising to you that interests you. This includes using technologies to understand the usefulness to you of the advertisements and content that has been delivered to you, such as whether you have clicked on an advertisement. We use Third-Party software development kits (“SDKs”) relating to advertising and/or to add functionality of our Services. Third-Party SDKs may allow Third Parties including advertisers to collect your personal information to provide content that is more relevant to you. You may opt out of tracking by following the instructions below.3.4 THIRD-PARTY WEBSITESScaled Inference partners with Third-Party service providers who set cookies and tracking pixels for the Sites visitors on our behalf in order to deliver their services. These services include targeted online marketing and analysis of data collected through cookies. These technologies allow a partner to recognize your computer or mobile device each time you visit our Sites or other sites that also utilize the Third-Party’s services, but do not allow access to personal Information  from Scaled Inference. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.Third-Parties may choose to include Scaled Inference widgets on their sites. When you load a site that has chosen to include our widgets, we receive analytics information through a cookie that may be used to enhance our data or to improve our services.Scaled Inference does not have access to or control over these Third-Party technologies, and they are not covered by our Privacy Policy.3.5  THIRD-PARTY PAYMENT PROCESSINGWe may sell Virtual Items or Merchandise through our Services. When you make purchases through the Services, we process your payments through a Third-Party application, including the Apple App Store, Google Play App Store, Amazon App Store (together with any similar applications, “App Stores”) and Social Networking Sites (“SNS”) such as Facebook. The Third-Party application may collect certain financial information from you to process a payment on behalf of Scaled Inference, including your name, email address, address and other billing information.4.  ONWARD TRANSFER – SCALED INFERENCE MAY DISCLOSE YOUR INFORMATION4.1  INFORMATION WE SHAREWe do not sell, rent, trade, license, or otherwise disclose your information to Third-Parties, except in these limited circumstances: 
    • Disclosures to Scaled Inference Agents, Consultants and Related Third-Parties. Like most Internet businesses, we use Third-Parties to help ensure our business runs smoothly. We disclose your Personal Information to these Third-Party companies so they can perform their specific functions for us. For example, this data may be processed by the Site’s webhosting service provider and other IT service providers. We also may provide your name, email and phone number to marketing consultants in order to promote our Services. When we employ other companies to perform functions of this nature, we only disclose the information that they need to perform their requested function. We do not authorize them to retain, share, store, or use information provided by us for any other purpose.
    • Disclosures Required by Law or Otherwise. We may disclose your Personal Information if we believe, in good faith, that it’s necessary to: (1) comply with a legal obligation such as in response to a court order or subpoena; (2) protect the safety of fellow Site visitors or the public; (3) protect against legal liability; (4) protect and defend Scaled Inference’s rights or property; (5) to enforce our policies or contracts; (6) to collect amounts owed to us; (7) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (8) if we, in good faith, believe that disclosure is otherwise necessary or advisable.
    • Disclosures for a Business Transaction or Insolvency. We also may disclose your Personal Information in connection with an actual or proposed corporate transaction or insolvency proceeding involving all or part of Scaled Inference’s business or assets. For example, if we merge with another company, we may disclose your Personal Information to that company, but the disclosure would be subject to our Privacy Policy.
    • Marketing – Interest-Based Advertising and Third-Party Marketing.  Through our Services, Scaled Inference may allow Third-Party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities (e.g., your IP address, page(s) visited, time of day). We may also share such de-identified information as well as selected Personal Information (such as demographic information and past purchase history) we have collected with Third-Party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit non- Scaled Inference related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising. We may allow access to other data collected by the Site to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. If you prefer that we do not share your Personal Information with Third-Party advertising partners, you may opt out of such sharing at no cost by following the instructions below.4.2 INTERNATIONAL DATA TRANSFERSYou agree that all Personal Information collected via or by Scaled Inference  may be transferred, Processed, and stored anywhere in the world, including but not limited to the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. Your Personal Information may be accessible to law enforcement or other authorities pursuant to a lawful request. By providing information to Scaled Inference, you explicitly consent to the storage of your Personal Information in these locations.5. OPT-OUT (RIGHT TO OBJECT TO PROCESSING)5.1 GENERALYou have the right to object to and opt out of certain uses and disclosures of your Personal Information. Where you have consented to Scaled Inference’s Processing of your Personal Information, you may withdraw that consent at any time and opt out of further Processing by contacting privacy@ScaledInference.com. Even if you opt out, we may still collect and use non-Personal Information regarding your activities on our Sites and/or information from the advertisements on Third-Party websites for non-interest based advertising purposes, such as to determine the effectiveness of the advertisements.5.2 EMAIL AND TELEPHONE COMMUNICATIONS. If you receive an unwanted email from us, you can unsubscribe at any time by emailing us at privacy@scaledinference.com. We will process your request within a reasonable time after receipt. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding Scaled Inference’s Services and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms or this Privacy Policy).5.3 MOBILE DEVICESWe may occasionally send you push notifications through our mobile applications with notices that may be of interest to you. You may at any time opt out from receiving these types of communications by changing the settings on your mobile device. Scaled Inference may also collect location-based information if you use our mobile applications. You may opt out of this collection by changing the settings on your mobile device.5.4 BLOCK COOKIES AND TARGETED ADVERTISING You can prevent Scaled Inference and its Third-Party partners from setting and accessing cookies on your computer by setting your Internet browser to block cookies. Please note that cookie-based opt outs are not effective on mobile applications. However, on many mobile devices, application users may opt out of certain mobile ads via their device settings. You also may remove yourself from the targeted advertising of companies participating in the Digital Advertising Alliance program by opting out here or emailing privacy@scaledinference.com To be clear, whether you are using our opt out or an online industry opt out, these cookie-based opt outs must be performed on each device and browser that you wish to have opted out. For example, if you have opted out on your computer browser, that opt out will not be effective on your mobile device. You must separately opt out on each device. Advertisements on Third-Party websites that contain the AdChoices link and that link to this Privacy Policy may have been directed to you based on anonymous, non-Personal Information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes.5.5 DO NOT TRACKOur Sites do not act on “do not track” request headers, but you can still limit tracking by taking the steps described above.6.  RIGHTS OF ACCESS, RECTIFICATION, ERASURE AND RESTRICTION.You may inquire as to whether Scaled Inference is Processing Personal Information about you, request access to Personal Information, and ask that we correct, amend or delete your Personal Information where it is inaccurate or has been Processed in violation of applicable data privacy law. Where otherwise permitted by applicable law, you may send an e-mail to privacy@scaledinference.com or use any of the methods set out in this Privacy Policy to request access to, receive (port), seek rectification, or request erasure of Personal Information held about you by Inference. Please include your full name, email address associated with your account, and a detailed description of your data request. Such requests will be processed in line with local laws.Although Scaled Inference makes good faith efforts to provide Individuals with access to their Personal Information, there may be circumstances in which Scaled Inference is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If Scaled Inference determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, Scaled Inference will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information7.  DATA RETENTIONScaled Inference retains the Personal Information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.You may inform us of any changes or requests in regards to your Personal Information, and in accordance with our obligations under local laws, we will use all reasonable means to update or delete your Personal Information accordingly. Please email Scaled Inference at privacy@scaledinference.com. 8.  HOW WE PROTECT YOUR PERSONAL INFORMATIONWe use technical, physical and administrative safeguards to secure your Personal Information. Online, we encrypt your Personal Information using Secure Sockets Layer (“SSL”). SSL allows for a private, reliable connection to our Sites where your identity is authenticated with cryptography. Offline, we restrict access to your Personal Information to only those Scaled Inference employees who need it to perform a specific job function. And we require all Scaled Inference employees with access to your Personal Information to follow specific practices concerning its proper handling. We also hold our vendors who need access to your Personal Information to strict confidentiality requirements. Third-Party service providers assist us with the physical security of some of our computer hardware.While we use industry-standard precautions to safeguard your Personal Information, we cannot guarantee absolute security; 100% security does not exist anywhere online or off.9.  INTERNATIONAL USERSBy using the Sites, Scaled Inference will transfer data to jurisdictions outside of the United States.  By choosing to visit the Sites, utilize the Services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of California and the adjudication of any disputes arising in connection with Scaled Inference or the Sites will be in accordance with the Terms.10.
